退款政策
This Refund Policy explains when and how you may obtain a refund for Subscriptions to PAIO and PAVE purchased from PopcornSAR Co., Ltd. ("PopcornSAR", "we", "us"). This Policy is incorporated into and forms part of our Terms of Service. Capitalised terms used but not defined in this Policy — including "Transaction", "Subscription", "Free Trial", "Account", "Product", and "Consumer" — have the meanings given to them in Section 1 of the Terms of Service.
For purchases made through Freemius (international), this Policy is intended to be consistent with the Freemius Terms & Conditions of Sale presented to you at checkout and with the Freemius Terms of Service (https://freemius.com/terms/). Freemius, Inc. is the Merchant of Record for such purchases and issues approved refunds to your original payment method on our instruction.
1. Summary
- We honour the statutory right of withdrawal granted to you by the consumer protection law that applies to you (Section 2.1).
- In addition, we offer a 14-Day Money Back Guarantee: if a defect makes a Product unusable within fourteen (14) days of your initial paid Transaction for that Product, you report it to us within that period and give us a reasonable opportunity to fix it, and we cannot resolve it, we refund you in full (Sections 2.2 and 2.3). The guarantee runs separately for each Product.
- We provide a seven (7) day Free Trial of each Product that requires no payment, so you can install and evaluate the Product in full, on your own machine and against your own projects, before you buy. That is the intended way to decide whether a Product is right for you.
- Section 3 sets out when a refund may be refused or limited, including change of mind, problems we were not given the chance to fix, and repeated buy-and-refund.
- The guarantee covers your initial paid Transaction for each Product only. Renewals, upgrades, plan changes, billing-cycle changes, and additional license seats do not start a new 14-day period (Section 5.3). Your statutory rights under Section 2.1 are unaffected.
2. Your Right to Cancel and Obtain a Refund
2.1 Statutory Right of Withdrawal
We honour the statutory right of withdrawal granted to you by the consumer protection law applicable to you, including in particular:
| Jurisdiction | Statutory right | Legal basis |
|---|---|---|
| Republic of Korea | 7 days, no reason required | 「전자상거래 등에서의 소비자보호에 관한 법률」 (Act on the Consumer Protection in Electronic Commerce), Article 17(1) |
| European Union / EEA | 14 days, no reason required | Directive 2011/83/EU, Article 9(1) |
| United Kingdom | 14 days, no reason required | Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 |
| Japan | as provided by law | Consumer Contract Act (消費者契約法) |
| United States | as provided by law | applicable state consumer protection law |
and any other law applicable to you. Where such a law grants you rights that go beyond this Policy, that law prevails to the extent of any conflict, and nothing in this Policy — including Section 3 — limits or excludes any right you cannot waive.
Statutory rights of withdrawal generally apply only to a Consumer: a natural person acting for purposes outside that person's trade, business, craft, or profession. PAIO and PAVE are professional engineering tools offered for business and professional use (Section 2.1 of the Terms of Service). Whether you are a Consumer in a particular purchase is determined objectively under the law applicable to you, and not by any statement made at checkout. Section 2.2 extends a separate contractual guarantee to everyone, whether or not they are Consumers.
Additional Korean right. Under Article 17(3) of the Act on the Consumer Protection in Electronic Commerce, a Korean Consumer may withdraw where the Service differs from our advertising or from the contract, within three (3) months from the day the Service is supplied and within thirty (30) days from the day you became aware, or could have become aware, of that fact. This right survives the commencement of supply, and neither the reporting conditions in Section 2.3 nor the limits in Section 3 apply to it.
Statutory limitations for digital content. Each of the statutes above limits the right of withdrawal once the supply of digital content has begun, provided we have satisfied the accompanying conditions:
- Republic of Korea — Article 17(2)(5). The right does not apply once supply of the digital content has commenced. Under Article 17(6) we may rely on this only if we both (i) clearly indicate that withdrawal will not be available and (ii) provide a trial product. We provide a seven (7) day Free Trial of each Product, and we indicate the limitation at checkout before you pay. Where a contract consists of a divisible service or divisible digital content, the limitation does not extend to any portion whose supply has not commenced.
- European Union / EEA — Article 16(m). The right is lost where performance has begun and all three of the following are satisfied: (i) you gave prior express consent to performance beginning during the withdrawal period; (ii) you acknowledged that you would thereby lose the right of withdrawal; and (iii) we provided confirmation in accordance with Article 7(2) or 8(7).
- United Kingdom. Under regulation 37 of the 2013 Regulations the right is lost where supply began during the cancellation period with your express consent and your acknowledgement that the right would be lost. The cancellation period runs from the day the contract is concluded (regulation 30); if we fail to give you the cancellation information required by regulation 13, it is extended by up to twelve months (regulation 31).
Even where a statutory limitation applies, the guarantee in Section 2.2 remains available to you, on the terms set out in Sections 2.2 to 3.
2.2 Our 14-Day Money Back Guarantee
Independently of Section 2.1, and as a voluntary commitment:
If, within fourteen (14) calendar days after your initial paid Transaction for a Product is completed, you experience a defect, bug, or technical problem that makes that Product unusable for its intended purpose, and we are unable to resolve it, you may obtain a full refund of that Transaction. This guarantee is available to all purchasers — businesses, professionals, and Consumers alike, in every country — and applies separately to each Product, so a first purchase of PAIO and a first purchase of PAVE each carry their own fourteen-day period. It is subject to the conditions in Section 2.3 and the limits in Section 3.
Why the guarantee is framed this way. We provide a seven (7) day Free Trial of each Product that requires no payment, so you can install and evaluate the full product on your own machine, against your own projects, before you pay anything. This guarantee therefore exists to protect you against a problem that only becomes apparent after purchase. It is not a second evaluation period and it is not a general change-of-mind right.
Initial Transaction only. This guarantee applies to your initial paid Transaction for each Product. Subscription renewals do not start a new 14-day period; a first purchase of a Product you have not previously bought does.
The 14 days run from the day your initial paid Transaction is completed. Where applicable law fixes a later starting point, or provides a longer period, the later start or longer period applies to your statutory right under Section 2.1.
2.3 Conditions — the Support Process
To be eligible under Section 2.2, you must:
- Report the problem within the 14-day period via the "Contact Us" tab on our website (https://autosar.io), with enough detail for us to reproduce it — the Product and its version, operating system, the steps you took, and any error message or log output;
- Give us a reasonable opportunity to resolve it. We will acknowledge your report within two (2) business days and will work with you to diagnose and fix or work around the problem; and
- Cooperate reasonably with our support team, including by providing requested diagnostic information and by testing proposed fixes or workarounds.
If we are unable to resolve the problem within a reasonable period, or if we determine that it cannot be resolved, we will issue a full refund of your initial paid Transaction. If we do resolve it, no refund is due under Section 2.2.
Time spent with our support never counts against you. If you report a problem within the 14-day period, your eligibility under Section 2.2 is preserved while we investigate — including where our investigation concludes after the 14 days have expired.
2.4 How to Withdraw — Information for Consumers in the EU/EEA and the United Kingdom
Right of withdrawal. You have the right to withdraw from this contract within fourteen (14) days without giving any reason. Because the Products are digital content supplied without a tangible medium, the period begins on the day the contract is concluded.
How to exercise it. Inform us of your decision by an unequivocal statement — by email to contact@popcornsar.com, through the "Contact Us" tab on https://autosar.io, or to Freemius using the support link in your purchase confirmation email. You may use the model form below, but you are not obliged to. To meet the deadline it is enough that you send your communication before the period expires.
Effects. We will reimburse all payments received from you without undue delay and in any event not later than fourteen (14) days from the day on which we are informed of your decision, using the same means of payment you used, and you will not incur any fee.
If we did not tell you about this right. Where we have not provided the information required by Article 6(1)(h) of Directive 2011/83/EU (or regulation 13 of the UK Consumer Contracts Regulations 2013), the withdrawal period is extended by up to twelve (12) months — Article 10 of the Directive; regulation 31 of the 2013 Regulations.
Model withdrawal form (complete and return only if you wish to withdraw)
To PopcornSAR Co., Ltd., 2F Nobel Building, 16 Teheran-ro 78-gil, Gangnam-gu, Seoul, Republic of Korea — contact@popcornsar.com: I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract of sale for the following goods (*)/for the provision of the following service (*), Ordered on (*)/received on (*), Name of consumer(s), Address of consumer(s), Signature of consumer(s) (only if this form is notified on paper), Date (*) Delete as appropriate.
2.5 Legal Guarantee of Conformity — Consumers in the EU/EEA and the United Kingdom
The guarantee in Section 2.2 is in addition to, and does not replace or limit, your statutory rights where the Product does not conform to the contract. Those rights last longer than fourteen days and are not subject to Section 2.3 or Section 3.
- EU/EEA. Under Directive (EU) 2019/770 we are liable for a lack of conformity that exists at the time of supply and becomes apparent within two (2) years for a single act of supply, or throughout the subscription term where supply is continuous (Article 11). You are entitled to have the Product brought into conformity and, where that fails, to a price reduction or termination (Article 14). The burden of proving conformity lies with us for one year, or for the whole term of continuous supply (Article 12).
- United Kingdom. Under the Consumer Rights Act 2015, sections 34 to 36, digital content must be of satisfactory quality, fit for a particular purpose made known to us, and as described; sections 42 to 45 give you the right to repair or replacement, and to a price reduction or refund. These rights cannot be excluded or limited (section 47).
3. When a Refund May Be Refused or Limited
The guarantee in Section 2.2 is intended to remove the risk from buying a Product — not to provide a way of using it for free.
Section 3.1 lists what the guarantee does not cover at all. Sections 3.2 and 3.3 list circumstances in which we may refuse or limit a refund that would otherwise qualify.
3.1 Outside the Guarantee
The following fall outside Section 2.2 from the outset. They are not discretionary grounds of refusal — the guarantee simply does not extend to them. This Section describes the scope of the voluntary guarantee only. Where you have a statutory right under Section 2.1, you may exercise it for any reason or no reason, and nothing in this Section 3 applies to it. This Section describes the scope of the voluntary guarantee only. Where you have a statutory right under Section 2.1, you may exercise it for any reason or no reason, and nothing in this Section 3 applies to it.
- (a) A change of mind, a Subscription purchased by mistake, or a decision that you no longer need the Service. The seven (7) day Free Trial is provided so that you can make that decision before purchasing.
- (b) A capability that the Product has never been advertised or documented as providing. This does not cover a case where the Product is supplied otherwise than in accordance with the contract.
- (c) A problem caused by your hardware, operating system, network, third-party software, or an environment that does not meet our published system requirements.
- (d) A problem that we resolved, that you did not report within the 14-day period, or for which you did not give us a reasonable opportunity to resolve under Section 2.3.
3.2 Repeated or Excessive Refunds
Where a request would otherwise qualify under Section 2.2, we may nevertheless refuse or limit it in the following circumstances.
- (e) Re-purchase after a refund. Where you have received a refund for a Product within the preceding twelve (12) months, we may refuse a refund on a subsequent purchase of that same Product. Buying a different Product for the first time is not a re-purchase.
- (f) Repeated buy-and-refund. Where we hold evidence that the same Product has been purchased and refunded more than twice in the preceding twelve (12) months.
- (g) Excessive requests. Where more than three (3) refund requests in the preceding twelve (12) months are associated with the same person, entity, Account, email address, device, or payment method — including requests made through multiple Accounts.
3.3 Conduct
- (h) Where you continue to use the refunded Product, or retain or use a license key for it, after a refund has been issued. On refund, the Subscription and license terminate and the license key is deactivated (Section 4).
- (i) Where there is evidence of fraud, use of a stolen or unauthorised payment method, or materially false information supplied in connection with the purchase or the refund request.
- (j) Where the Subscription has been terminated for breach of Section 9 (Acceptable Use and Software Integrity) of the Terms of Service — including obtaining a Product from outside an Official Distribution Channel, redistributing it, or using a copy in which license validation has been removed or circumvented.
- (k) Where you have raised a chargeback or payment dispute in respect of the Transaction. In that case the dispute process applies instead of the guarantee in Section 2.2, and we will not pay twice for the same Transaction. This does not affect your statutory rights under Section 2.1.
3.4 Transactions Outside the Scope of Section 2.2
For reference, the guarantee does not extend to renewal Transactions, upgrades, plan changes, billing-cycle changes, additional license seats, or any partial or unused portion of an active billing period. These fall outside the scope of Section 2.2 altogether rather than being a discretionary ground of refusal under this Section — see Section 5.3.
3.5 What We Do Not Treat as Abuse
For the avoidance of doubt, none of the following is refund abuse:
- requesting a refund and immediately re-purchasing in order to take advantage of a promotion or a corrected price;
- correcting an obvious payment or plan-selection error;
- reporting a technical problem under Section 2.3 in good faith, whether or not we were able to resolve it; or
- where a Korean business customer has purchased through our online checkout and requires a Korean tax invoice (세금계산서) that cannot be issued for that Transaction, requesting a refund in order to re-contract with PopcornSAR directly.
3.6 How These Limits Operate
- Statutory rights are unaffected. This Section does not limit any right you cannot waive under the law applicable to you (Section 2.1). Where such a right applies, it prevails over this Section.
- Case-by-case review. Requests are reviewed individually. We may refuse or limit a request only where a ground listed in Section 3.2 or 3.3 actually applies; Section 3.1 and Section 3.4 describe what the guarantee never covered, and involve no such discretion.
- Ex gratia approvals. Where we approve a refund that Section 2.2 did not require us to give, that approval is voluntary and does not oblige us to do the same again.
- Notice and review. Where we refuse a request under this Section, we will tell you which ground applies within ten (10) business days, and you may ask us to review that decision.
4. Effect of a Refund
Where you exercise a statutory right of withdrawal under Section 2.1, no approval by us is required. We will reimburse the full amount of the Transaction without undue delay and not later than fourteen (14) days after the day we are informed of your decision to withdraw — for Korean Consumers, within three (3) business days of the day of withdrawal, as required by Article 18(2) of the Act on the Consumer Protection in Electronic Commerce, together with any statutory late-payment interest; where you paid by card, we will also ask the card issuer without delay to suspend or cancel the charge (Article 18(3)).
Where a refund is granted under the guarantee in Section 2.2, we will reimburse the full amount of the Transaction without undue delay and not later than fourteen (14) days after we confirm that the refund is approved.
Reimbursement is made using the same means of payment you used for the original Transaction, and you will not incur any fee from us as a result.
On refund, the Subscription and the associated license terminate, your license key is deactivated, and your right to access and use the Service ceases. You must stop using the refunded Product and remove it from your devices.
5. Subscriptions, Renewals, Upgrades, and Free Trials
5.1 Auto-Renewal
Paid Subscriptions configured to auto-renew will renew at the end of each billing period (monthly or annual) at the then-current rate until you cancel.
5.2 How to Cancel Future Renewals
You may cancel your Subscription at any time through your Account or by submitting a request through the "Contact Us" tab on our website (https://autosar.io). For Subscriptions purchased through Freemius, you may also cancel using the subscription-management link included in your Freemius purchase confirmation email. Cancellation takes effect at the end of the current billing period; you retain access to the Service until that point.
5.3 Only the Initial Transaction Carries the 14-Day Guarantee
The right in Section 2.2 applies to your initial paid Transaction for each Product only. A first purchase of a Product you have not previously bought is itself an initial paid Transaction and carries its own 14-day period. For the avoidance of doubt, none of the following starts a new 14-day period: a renewal; an upgrade within the same plan; a change from one plan to another; a change of billing cycle; or the purchase of additional license seats. Except as provided in Section 16.2(e) of the Terms of Service, there is no refund for a partial or unused portion of an active billing period.
5.4 Free Trials
Our seven (7) day Free Trial, available separately for each Product, does not require payment. If you do not actively elect to convert to a paid Subscription, no payment will be charged and no refund is required or possible.
6. How to Request a Refund
6.1 Purchases Made Through Freemius (International)
Submit your request through the "Contact Us" tab on our website (https://autosar.io), or by replying to the support or subscription-management link included in your Freemius purchase confirmation email. Please include:
- the email address you used at checkout;
- the Freemius order, invoice, or license number shown on your purchase confirmation or invoice;
- the date of purchase; and
- a description of the problem — the Product and its version, operating system, steps to reproduce, and any error message or log output (see Section 2.3). If you are exercising a statutory right under Section 2.1, say so and no reason is needed.
PopcornSAR reviews the request and, where it is approved, instructs Freemius — as Merchant of Record — to issue the refund. We will acknowledge receipt within two (2) business days and process approved refunds within the periods set out in Section 4.
6.2 Purchases Made Through Toss Payments (Republic of Korea)
Submit your request through the "Contact Us" tab on our website (https://autosar.io). Please include:
- the email address associated with your PopcornSAR Account;
- the Toss Payments transaction ID, payment approval number, or receipt number;
- the date of purchase; and
- a description of the problem — the Product and its version, operating system, steps to reproduce, and any error message or log output (see Section 2.3). If you are exercising a statutory right under Section 2.1, say so and no reason is needed.
We will acknowledge receipt within two (2) business days and process approved refunds within the periods set out in Section 4.
7. How Refunds Are Issued
Refunds are issued through the same payment processor used for the original Transaction, to the original payment method:
- Freemius (international) — processed by Freemius, as Merchant of Record, to the original payment method. Where the original invoice included VAT, GST, or sales tax collected by Freemius, that amount is refunded together with the price, and Freemius issues the corresponding credit note.
- Toss Payments (Republic of Korea) — processed by us via Toss Payments to the original payment method; where required by Korean tax law we will issue a corrected tax invoice (수정세금계산서).
Time to appear on your statement depends on your payment method:
- Credit/debit cards: typically 5–10 business days (sometimes longer depending on the issuing bank).
- PayPal: typically 1–3 business days.
- Other local payment methods: as determined by the relevant provider.
Currency conversion fees, foreign-transaction fees, or bank fees that were applied by your card issuer or bank at the time of the original payment are not refundable by PopcornSAR, Freemius, or Toss Payments.
8. Changes to This Policy
We may update this Refund Policy from time to time. Because this Policy forms part of the Terms of Service, any amendment is announced and notified in accordance with Section 16.2 of the Terms of Service — as a rule at least seven (7) days before the effective date, and at least thirty (30) days before, with individual notice, where the amendment is unfavourable to you or concerns a material matter (refunds are a material matter under Section 16.2(c)). The "Last revised" date at the top of this Policy reflects the most recent revision. The Policy in effect at the time of your purchase will govern that purchase.
